These Terms and Conditions (“Terms”) explain the rules for using the BOUTIQ™ website and buying our products. In these terms and conditions, “BOUTIQ,” “we,” “us” and “our” refer to the BOUTIQ™ brand. Because you agree to them by using the site, please read them carefully. If you don’t agree, you should not use the website.

1. Who Can Accept These Terms and Conditions
To accept these Terms and Conditions, you must be at least 18 years old, or the minimum legal age for cannabis products where you live, whichever is higher. Therefore, we may ask for proof of age at any time. If we believe someone under the legal age is using the site, we may cancel the order or restrict access. Cannabis laws also differ from state to state, so our products are available only where they are legal. For example, BLOX™ is currently exclusive to Arizona. Please remember that you are responsible for knowing the laws where you live and where you receive your order. Otherwise, we may refuse or cancel any order that we believe would break the law.
2. Products and Availability
We work to describe our products accurately, including the boutiq switch lineup (btq v5, boutiq v4 and boutiq v3), SWITCH™ devices, 510 CART™ and boutiq carts, SNACK PACKS™, BLAST™, BLOX™ and pre rolls. However, colors, flavors and packaging can vary slightly between batches and drops. Limited releases may also sell out without notice. In addition, we don’t make medical claims, because our products are not intended to diagnose, treat, cure or prevent any condition.
3. Ordering, Pricing and Payment
All orders are subject to acceptance and availability. Prices can change without notice, and we may correct pricing errors, even after you place an order. When you place an order, you confirm that the payment method belongs to you and that your information is accurate. Meanwhile, accepted payment methods, taxes and any fees are shown at checkout. By ordering, you also accept these Terms and Conditions in full.
4. Shipping and Delivery
Our Shipping page covers shipping rules, delivery times and any age check at delivery. However, delivery estimates are not guarantees. Because carriers handle the final delivery, risk of loss passes to you once the carrier delivers your order.
5. Returns and Refunds
Our Returns and Refund page explains our return and refund rules. Because of the nature of the products, the policy on that page applies to every order. If your order arrives damaged or incorrect, please contact us as soon as possible so that we can help. Those return rules form part of these Terms and Conditions.
6. Authenticity and Counterfeit Products
We protect our products with Boutiq Verify and a holographic authenticity seal. However, we can only stand behind products bought from us or from sellers we have authorized. As a result, we don’t guarantee products from unauthorized sellers, and we aren’t responsible for counterfeit or tampered goods, including any fake boutiq disposable or boutiq switch device. If you think you have a fake product, please contact us.
7. Intellectual Property
BOUTIQ™, SWITCH™, SNACK PACKS™, BLAST™, 510 CART™, BLOX™ and all related names, logos, designs, packaging, images and website content belong to us or our licensors. Therefore, you may not copy, reproduce, modify or use them for commercial purposes without our written permission.
8. Acceptable Use Under These Terms and Conditions
When you use the site, you agree not to:
- use it for any unlawful purpose
- provide false information or misrepresent your age
- interfere with the site’s security or operation
- scrape or copy site content without permission
- resell products in violation of the law or these Terms
If you break these rules, we may suspend your access or cancel your orders.
9. Health and Safety
Cannabis affects people differently, so please use our products responsibly. Also, keep them away from children and pets. In addition, don’t drive or operate machinery after use. If you have health concerns, speak with a qualified professional. Ultimately, you use our products at your own risk.
10. Disclaimers, Liability and Indemnification
The website and products are provided “as is” and “as available.” To the fullest extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose. Likewise, BOUTIQ and its team are not liable for indirect, incidental or consequential damages arising from your use of the site or products. Our total liability for any claim will not exceed the amount you paid for the product at issue. In addition, you agree to hold BOUTIQ harmless from claims, losses and expenses arising from your breach of these Terms and Conditions or your misuse of the site or products.
11. Privacy and Third-Party Links
Our Privacy Policy explains how we collect and use your information. Meanwhile, the site may link to other websites. Since we don’t control them, we aren’t responsible for their content or practices.
12. Governing Law for These Terms and Conditions
California law governs these Terms and Conditions, without regard to conflict-of-law rules. Therefore, any dispute will be handled in the courts located in the City and County of Los Angeles, California, unless the law requires otherwise.

We may update these Terms and Conditions at any time. The “Last updated” date shows the latest version. As a result, continued use of the site means you accept the changes, so please review this page from time to time.
